Megan’s Law Registration in New Jersey

Registering as a sex offender pursuant to Megan’s Law can have a devastating impact on you and everyone residing in your household. The legislature indicated that the purpose of Megan’s Law is to identify and alert the public when it becomes necessary for public safety. However, Megan’s Law provisions are an intrusion that will accompany you for years or even for life in certain instances.

When is registration required?

Megan’s Law registration is required for any of the following offenses:

  • False imprisonment (limited to circumstances in which the offender falsely imprisons a minor victim when the offender is not the victim’s parent or guardian);
  • Criminal restraint;
  • Kidnapping;
  • Luring or enticing;
  • Endangering the welfare of a child by engaging in child pornography;
  • Endangering the welfare of a child by engaging in sexual conduct;
  • Promoting prostitution of a minor child;
  • Sexual contact with a minor;
  • Aggravated sexual assault; and
  • Sexual assault.

If convicted for any of the offenses listed above, you will be required to submit some personal information. The form prepared by New Jersey’s Superintendent of State Police requests the convicted individual’s personal information including the person’s name, Social Security number, date of birth, height, weight, address(es), and place of employment. The individual will also be required to provide information regarding the circumstances of the crime(s) committed requiring registration.

The records are open for inspection by law enforcement officials and, in some instances, the public. The statute permits any law enforcement agency, regardless of the location of the agency, to have access to registration forms. In addition, law enforcement agencies are permitted to provide the information to the public if releasing the information is necessary for public protection. However, the information is available via an internet registry for any individual with a moderate or high risk of reoffending.
