Initially, the defendant faced a trial for one count of drug possession and one count of drug sales. But when the prosecution called on the investigator to testify, the state trooper invoked his right to remain silent. He later clarified that he was “pleading the Fifth” on advice from his attorney. The implication is that his statements could be self-incriminating.

With the DA’s office remaining tight-lipped about this development, we can only guess about why the state trooper might be facing a federal investigation. Whatever the DA discovered, it was enough to make the drug case impossible to prosecute.
