Often, traffic violations are fairly minor offenses. But even a minor speeding ticket can result in fines, have an effect on insurance rates, and, if a driver accumulates too many tickets, can result in the loss of driving privileges. More serious offenses carry more serious penalties, including incarceration or revocation of a driver’s license. If you have received a ticket for a traffic violation, call our office today, and we can help you defend your ticket and avoid the serious consequences that can follow, let our experienced New City traffic violations attorney help you.

Traffic Violations and Consequences

New York, New Jersey, and Connecticut law include many types of traffic violations. We can help you defend citations for violations including:

The most obvious and common consequence of a traffic ticket is having to pay a fine. But other penalties and repercussions can result, including:

  • Points on your driving record;
  • Driver’s license suspension or revocation;
  • Fees paid to the DMV;
  • Insurance consequences; and
  • Jail time.

If you have received a traffic ticket, it might seem easier to just pay the fine. But paying the ticket means that you have plead guilty to the offense, which leads to other consequences, importantly, to insurance increases and points on your driving record.

Points

New York, New Jersey, and Connecticut all use the point system for driving records. In each state, a driver gets points on his or her record after committing a traffic violation.

If you accumulate enough points, your license will be suspended. In New York, your license may be suspended if you accumulate 11 points within 18 months. In New Jersey, the limit is 12 or more points within two years. Connecticut licenses will be suspended if your get 10 points within 24 months.

States also may assess surcharges for accumulating points and for other offenses, such as driving without a license, operating an uninsured vehicle, DWI, or refusing a breathalyzer.

Insurance Consequences

A driver’s insurance rates can skyrocket after a paying a ticket. Insurance companies sometimes use the state’s driving record point system, and sometimes create their own point systems, but whichever method they use, points on your record mean an increase in auto insurance rates. If you retain the services of an attorney, however, you may be able to avoid having the pay the fine, and thus save substantial amounts of money on insurance.

Out-of-State Violations

New York, New Jersey, and Connecticut are all party to interstate compacts that mean that states share information about moving violations. Thus, if you get a ticket out of state, you will still suffer in-state penalties. New Jersey residents who commit moving violations out of state have two points added to their New Jersey driving records, regardless of what the violation is. Likewise, if you are from another state but get a ticket in New Jersey, New Jersey will report the violation to your home state, which will assess points according to its laws.

New York only adds out-of-state moving violations to a New York driver’s record if they either were committed in Ontario or Quebec, or if they were drug- or alcohol-related. Connecticut does not generally assess points for out-of-state moving violations. But if a Connecticut driver fails to respond to an out-of-state ticket, Connecticut will suspend the driver’s license.
